Rights of Way
We have received the below from Suffolk County Council.
Anyone who believes there is evidence of the legal/historic existence of a public right of way that is not recorded on the definitive map and statement can make a formal application to have it added, even if the route is no longer available on the ground and has not been used for many years. This is on the basis that if it did once exist and has never been legally stopped up, then in law it still exists, a term known as “once a highway, always a highway’.
Based on historical documentary evidence the applicant claims that this route should be recorded and our investigation will look into this and make a recommendation to the Development and Regulation committee.
The County Council has a statutory duty to investigate all such applications.
